What the CLARITY Act Is
The Digital Asset Market Clarity Act (H.R. 3633), known as the CLARITY Act, is a market-structure bill that sets clear federal rules for how digital assets are regulated in the United States. Today, that responsibility is contested and undefined, which leaves consumers, developers, and businesses without a reliable rulebook.
In plain terms, the bill would:
- Divide oversight between two regulators. The Commodity Futures Trading Commission (CFTC) would oversee digital commodities and their spot markets, while the Securities and Exchange Commission (SEC) would continue to regulate digital assets that function as securities.
- Define the categories. It creates a classification framework so a token's legal status is knowable in advance, rather than decided after the fact through enforcement.
- Protect consumers. It introduces disclosure requirements, custody and customer-property protections, and clearer bankruptcy safeguards for people who hold assets on a platform.
- Set rules for the whole market. It addresses exchange registration, stablecoin provisions, decentralized finance, illicit-finance safeguards, and developer protections.
Why It Matters — and Why Now
Other jurisdictions have already written their rules. The European Union's MiCA framework is in force, and the United Kingdom, Singapore, and the United Arab Emirates have each moved to attract digital-asset businesses with defined regulation. Without a federal framework of its own, the United States risks pushing innovation, investment, and jobs offshore — and leaving American consumers with weaker protections in the meantime.
The CLARITY Act is the country's clearest opportunity to change that. Passing it would let the United States lead on sensible digital-asset regulation rather than fall behind, giving responsible businesses room to build at home and giving law enforcement better-defined tools against fraud and abuse.
The window is narrow. The bill is eligible for a full Senate vote, but no floor vote has been scheduled. Clearing the Senate requires bipartisan support to reach the 60-vote threshold. A short, respectful message from a constituent is one of the most effective ways to tell a Senator that this vote matters to the people they represent.
